Biography

James G. Goggin has over 30 years of experience litigating nationwide in the intellectual property area, including trademark, broadcast licensing fee agreements, copyright infringements, trade secrets and patent litigation. Notable trial results include the dismissal of all claims against client Chamilia Jewelry on the eve of trial in a patent infringement case in Maryland, a jury verdict of willful trademark infringement for a New Hampshire high end kitchen goods store against Maytag Corporation, and a defense jury verdict in Maine for a radio station accused of trademark and copyright infringement and unfair competition. Jim also defended a carpet manufacturer against copyright infringement claims by a noted local designer and secured a jury verdict that was a small fraction of the Plaintiff's pretrial settlement demand.

Jim represents a variety of parties in patent litigation across the country. He has handled patent cases in technologies as diverse as medical devices, internet browsers and applications, computer networks, radio devices and biometric payments in federal courts in Maine, Delaware, Maryland, Colorado and Texas. Jim recently handled a patent case involving an infusion system used to meter and simultaneously deliver fluids from multiple fluid sources into a patient’s body through claim construction in the federal district court and up through an appeal to the Federal Circuit Court of Appeals. Working closely with experts to understand the technology so that it can be simply explained to a judge or jury is key to Jim’s ability to favorably resolve cases for clients.

In the trademark area, Jim has represented clients such as:

  • Gifford’s Dairy
  • Attrezzi
  • Black Diamond Sportswear
  • Ralph Lauren's Polo Fashions
  • The Hinckley Yacht Company
  • Sabre Yacht Corporation

He defended a manufacturer of high-quality wooden pens against trademark infringement accusations by a large multi-national competitor and obtained a settlement of a substantial cash payment and the right to continue using the disputed trademark.

Clients in the broadcast license/copyright area include:

  • Twentieth Century Fox in a programming dispute with its local Fox 51 affiliate.
  • WABI-TV in a dispute with Time Warner Cable over the unauthorized retransmission of television programs over cable networks.

His clients in the unfair competition/trade secrets area have included:

  • Morgan Stanley and UBS PaineWebber (financial services),
  • Saga Communications (broadcast)
  • Computer Software Associates (software).

Mr. Goggin also advocates and tries cases in other substantive areas of the law. For example, for many years he has represented psychiatrists insured by the American Psychiatric Association’s insurance company (and others) in administrative licensing matters and medical malpractice claims. In complex tort matters he has defended some of the country’s leading product manufacturers in products liability cases and has been involved for both plaintiffs and defendants in multi-party aviation accident litigation.

Jim was drawn to Maine for its coast and mountains. He sails the Maine coast each summer and has ventured with family into waters as distant as Croatia and Corsica. Recent climbs include Mt. Katahdin, Maine and Mt. Washington, New Hampshire (in winter) and Jim and eldest daughter Jennifer are currently training for a fall attempt on Mt. Rainier, Washington.
