Insolvent General Contractor and Mechanic’s Lien Claims

  • A.R. Couture Construction Corp. v. QualNet Communications, et al., 08-C-75 (N.H. Sup. Ct., Coos Cty.). Representation of a large major communications company in connection with general contractor’s abandonment of ten ongoing construction projects in Maine, New Hampshire and Massachusetts. We successfully defused possible lawsuits in three states and defended and resolved a lawsuit by a site-work subcontractor.
  • We also represented a national retailer in connection with development of new store in Maine when its unbonded general contractor failed to pay subcontractors and suppliers and abandoned the project prior to final completion. We worked with our client to negotiate claims and avoid liens and litigation from unpaid subcontractors and suppliers. We pursued claims against the general contractor.
  • S. D. Szetela v. Pro-Con, Inc. et al, RE-09-60 (Maine Sup. Ct., Cumberland Cty.). Represented area College on lawsuit arising from construction of its new Hockey Arena. This matter was settled without costs to the College.
